By accessing or using the OpenHome CRM platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
OpenHome CRM is a cloud-based customer relationship management platform designed for real estate agents and agencies. The Service includes lead capture tools, property management features, offer tracking, vendor reporting, QR code check-in functionality, and related services as described on our website.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your account.
4. Subscription and Billing
Some features of the Service require a paid subscription. You agree to pay all fees associated with your chosen subscription plan. Fees are billed in advance on a monthly or yearly basis depending on your plan selection. All payments are processed securely through Stripe. Subscription fees are non-refundable except as expressly stated in these Terms or required by applicable law.
5. Free Trial
We may offer a free trial period for new accounts. At the end of the trial period, you will need to select a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial at any time without prior notice.
6. Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to violate any applicable law or regulation, to infringe upon the rights of others, to transmit harmful or malicious content, to attempt to gain unauthorised access to the Service or its systems, or to interfere with the proper functioning of the Service.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. You retain ownership of the data you submit to the Service. We will not sell, share, or use your data for purposes other than providing and improving the Service.
8. Multi-Tenant Architecture
The Service operates on a multi-tenant architecture. Each agency's data is logically isolated from other agencies. We implement row-level security and access controls to ensure data separation between tenants.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by OpenHome CRM and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our prior written consent.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by cancelling your subscription and contacting us.
11. Limitation of Liability
To the maximum extent permitted by law, in no event shall OpenHome CRM, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the Service.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New South Wales, Australia.
